Mostra Terms of Service

Mostra is a catalogue, discovery, rating, publishing, and metadata platform for new media, including AI-made and hybrid films, narrative shorts, music videos, commercials, experimental work, documentaries, games, episodic series, Articles, workflows, tools, festivals, and creator profiles.

Mostra organizes creator-approved information about projects, contributors, production methods, tools, models, source links, audience activity, and related context. Unless we expressly agree otherwise in writing, Mostra is not the producer, distributor, publisher, agent, employer, studio, legal representative, rights-clearance service, or financial adviser of a creator or submitter.

Mostra may review, verify, organize, format, label, publish, reject, unpublish, or remove catalogue records as described in these Terms. A listing, verification status, approval, rating, review, or other platform label does not guarantee ownership, authorship, legality, quality, accuracy, or endorsement.

You must be at least 18 years old and legally capable of entering a binding agreement to create an account or submit content. If you use the Service for a company, studio, collective, client, or other organization, you represent that you have authority to bind that organization to these Terms.

You must provide accurate account information, keep your credentials secure, and promptly notify us if you believe your account has been compromised. You are responsible for activity performed through your account unless caused by Mostra's own breach of duty.

You may not impersonate another person or organization, misrepresent your affiliation, create an account for unlawful purposes, evade a suspension, sell or transfer an account without permission, or allow unauthorized people to use your account.

Some features may require a verified email address, creator verification, ownership attestation, third-party account connection, or additional review. We may refuse, limit, suspend, or revoke access when reasonably necessary for security, legal compliance, platform integrity, or enforcement of these Terms.

"Creator Content" means films, videos, audio, images, posters, thumbnails, stills, text, titles, descriptions, biographies, credits, names, social handles, prompts, workflows, production information, tool disclosures, source links, comments, and other materials that you submit, import, or approve for use on Mostra.

An "Approved Record" means Creator Content and factual information that you have submitted and expressly approved for publication through Mostra's submission flow or another written or recorded approval process.

You retain ownership of Creator Content that you own. Mostra will publish a creator-submitted catalogue record only after the submitter has affirmatively submitted it for review and Mostra has approved it. Mostra may suggest form fields or identify potential information from a caption or public source, but the submitter remains responsible for reviewing, correcting, and approving that information before submission. Public availability, silence, or failure to respond is not creator approval.

Mostra may make non-substantive technical, editorial, or visual changes needed to operate the catalogue, such as resizing an approved image, correcting obvious formatting, arranging approved fields, applying catalogue labels, or formatting approved text. We will not knowingly add or materially change substantive creator facts, credits, production claims, or descriptions without creator approval, except when needed to correct a legal, safety, security, or integrity issue.

Submission does not guarantee verification, approval, publication, placement, promotion, ranking, continued availability, or any commercial relationship. We may request supporting information, return a submission for changes, reject it, or place it on hold.

You are responsible for Creator Content and for every representation you make through the Service. By submitting or approving Creator Content, you represent and warrant that:

• the information is accurate to the best of your knowledge;
• you own the content or have all rights, licenses, permissions, releases, and consents needed to submit it and authorize the uses described in these Terms;
• you are authorized to act for any studio, team, client, collaborator, contributor, or rights holder you identify or represent;
• the content and Mostra's permitted use of it do not violate copyright, trademark, privacy, publicity, contract, confidentiality, music, talent, union, likeness, voice, data-protection, platform, or other rights;
• any AI models, tools, datasets, voices, likenesses, copyrighted material, or franchise-related material were used lawfully and with required permissions; and
• the content complies with these Terms and applicable law.

If Creator Content identifies or tags team members or other people, you are responsible for the accuracy of those details and for having an appropriate basis to provide them. Mostra may contact identified contributors, request confirmation, correct or remove credits, or restrict disputed information.

Do not submit confidential, trade-secret, embargoed, or NDA-protected information unless you are authorized to disclose it to Mostra and permit the uses described here.

For as long as an Approved Record is published, you grant Mostra a non-exclusive, worldwide, royalty-free license to host, cache, reproduce, technically process, resize, format, display, distribute through the Mostra catalogue, and link to the approved materials as reasonably necessary to operate, secure, improve, demonstrate, and promote Mostra and the Approved Record.

This license allows our service providers to process Creator Content only to provide services to Mostra. It also permits a lawful successor to exercise the license if it assumes Mostra's applicable obligations. The license does not transfer ownership of Creator Content, permit Mostra to sell or stream the complete underlying work, or imply that you endorse Mostra unless separately agreed in writing.

When an Approved Record is unpublished or deleted, the public-display portion of this license ends. Mostra may retain restricted copies only as reasonably necessary for legal compliance, security, fraud prevention, dispute resolution, enforcement, and limited backup restoration, as described in the Privacy Policy. Previously lawful third-party copies, caches, archives, or shares may remain outside Mostra's control.

You grant Mostra a perpetual, worldwide, royalty-free, non-exclusive right to use, adapt, combine, and implement suggestions, bug reports, and other feedback about the Service without compensation or attribution. This feedback right does not transfer ownership of your films, artwork, prompts, workflows, or other pre-existing Creator Content.

Mostra may allow you to connect a third-party account, including an Instagram professional account or X account, and import selected information into an editable draft. These integrations are optional.

When you connect Instagram, Mostra may receive the permissions and data described in the Privacy Policy, including an Instagram app-scoped account identifier, username, access token and expiration, and information about media available to that account. Mostra imports a caption or thumbnail into a submission only after you select that media. Mostra may analyze the selected caption to suggest form entries, but you must review and approve the submission.

When you connect X, Mostra may receive the permissions and data described in the Privacy Policy, including an X account identifier, profile information, access and refresh tokens, and information about Posts or X Articles available to that account. Mostra copies content into an editable Mostra Article draft only after you select it. You must review the draft and affirmatively save or publish it. Connecting X does not authorize Mostra to post to X on your behalf.

Connecting an account does not transfer ownership of your third-party content to Mostra. You remain responsible for complying with the third party's terms and for having authority to connect the account and import the selected material.

You may disconnect Instagram or X in Mostra Settings. Disconnecting removes Mostra's stored connection record and prevents future access through that connection. It does not automatically delete Creator Content that you previously selected, reviewed, and submitted or published on Mostra. You may delete that content using available controls or request deletion under Section 13 and the Privacy Policy.

Third-party services are operated independently and may change, suspend, restrict, charge for, or discontinue their APIs or features. Mostra is not responsible for third-party authentication, availability, policies, security, content, or decisions. Instagram, Meta, and X do not sponsor or endorse Mostra.

Mostra may ask submitters to disclose tools, models, prompts, workflows, credits, budget or efficiency estimates, consent status, intellectual-property status, production methods, source links, and team information. Unless expressly stated otherwise, these disclosures are supplied by users and are not independently guaranteed by Mostra.

You must not knowingly provide false or materially misleading AI, production, ownership, authorship, consent, performance, award, screening, or credit information. Mostra may label disputed or unverified information, request supporting materials, or correct, restrict, or remove inaccurate records.

Ratings, reviews, comments, watchlists, favorites, follows, tool ratings, workflow ratings, view counts, and other community activity reflect individual users and do not represent Mostra's endorsement or opinion.

You must not manipulate ratings or metrics, post spam, coordinate harassment, fabricate reviews, use bots or deceptive accounts, or interfere with another person's use of the Service. Mostra may moderate, hide, remove, rate-limit, reject, label, or investigate activity that appears abusive, fraudulent, unsafe, misleading, or harmful to platform integrity.

You may not use the Service to submit, display, promote, or facilitate:

• unlawful, infringing, fraudulent, deceptive, or materially misleading content;
• child sexual abuse material or sexual exploitation of minors, whether actual or synthetic;
• non-consensual intimate imagery, sexual deepfakes, trafficking, exploitation, or credible threats;
• content that violates another person's privacy, publicity, intellectual-property, contractual, or confidentiality rights;
• hate, targeted harassment, doxxing, malicious impersonation, or incitement of violence;
• malware, phishing, credential theft, spam, scraping, automated extraction, or attempts to bypass security or access controls;
• false ownership, identity, credit, verification, award, screening, or production claims; or
• unsafe, deceptive, or unlawful external links.

You may not reverse engineer, probe, disrupt, overload, benchmark for competitive misuse, systematically extract, or attempt to discover non-public source code, systems, data, or security controls except to the extent such a restriction is prohibited by law.

Mostra may preserve or report suspected illegal content and related information where permitted or required by law.

Verification indicates only that Mostra completed the verification step described on the Service; it is not a legal determination of ownership, authorship, authorization, or non-infringement.

Mostra may investigate a submission or account, request additional information, restrict visibility, reject or return a submission, disable community features, suspend access, unpublish an Approved Record, or terminate an account when reasonably necessary to address a suspected violation, rights complaint, security issue, fraud, safety concern, legal obligation, or operational risk.

We may act without advance notice when immediate action is reasonably necessary. Where appropriate, we may provide notice or an opportunity to respond, but we are not required to resolve private disputes between creators, studios, collaborators, clients, platforms, rights holders, or viewers.

If you believe a listing infringes your rights, identifies the wrong team, contains an unauthorized likeness, includes inaccurate ownership information, or links to unlawful or unauthorized material, email niveditagaur@mostra.media with:

• the project or profile title and Mostra URL;
• your name and relationship to the project or person;
• a clear description of the concern;
• the specific material to be corrected or removed; and
• supporting information reasonably sufficient to evaluate the request.

Submitting a knowingly false or misleading complaint may have legal consequences. Mostra may request identity or authority verification and may temporarily restrict content while reviewing a complaint.

The Service may link to source videos, social profiles, tools, festivals, creator websites, streaming platforms, and other third-party services. Mostra does not control and is not responsible for third-party content, availability, pricing, moderation, policies, security, or practices. A link, listing, rating, or profile does not constitute sponsorship, endorsement, verification, or a warranty.

Your use of third-party services is governed by their own terms and privacy policies.

You may request removal of an Approved Record or deletion of personal data by emailing niveditagaur@mostra.media. We may ask for information reasonably necessary to verify your identity, authority, and relationship to the requested data.

For a verified creator removal request, Mostra will aim to remove public access to the applicable Approved Record within 10 business days and delete active platform copies within 30 calendar days, unless a shorter period is required by law. Restricted backup copies may remain for up to 90 days. We may retain limited information when reasonably necessary for legal compliance, security, fraud prevention, dispute resolution, or enforcement. Retained copies will not remain public or be used for new promotion.

An authenticated submitter may use a self-service deletion control where available. That control immediately removes the active submission and any published Mostra record tied to it. Mostra may retain a minimal non-content deletion receipt for security, audit, duplicate-detection, and resubmission-confirmation purposes, as described in the Privacy Policy.

Where available, an authenticated user may select Delete Account at the bottom of Account Settings and complete the displayed confirmation. This immediately removes the active account, profile, social connections, drafts, submissions, authored Articles, and published records owned by that account, subject to restricted backups, minimal non-content receipts, legal preservation, and information contributed by other users as described in the Privacy Policy.

Disconnecting a third-party service alone does not automatically remove public catalogue records, Articles, community contributions, or content you previously chose to submit or publish. We will evaluate records involving other people under the Privacy Policy, applicable law, the rights of other users, and any legitimate preservation obligations.

The Service may contain beta, experimental, preview, or incomplete features. Those features may contain errors, change without notice, or become unavailable.

Mostra may modify, suspend, remove, rename, reorganize, or discontinue features, pages, listings, accounts, tools, ratings, comments, workflows, integrations, or datasets at any time. We may impose reasonable limits to protect security, performance, users, third parties, or the Service.

Mostra and its licensors own the Mostra name, brand, platform, software, interface, designs, taxonomy, database structure, and the selection, arrangement, compilation, and curation of catalogue records, together with aggregated or de-identified analytics. These Terms do not grant you ownership of or a license to those materials except the limited right to use the Service in accordance with these Terms.

You may not use Mostra's name, logo, design assets, or confusingly similar branding without written permission, except for lawful nominative reference.

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." MOSTRA DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND SECURITY.

Mostra does not warrant that Creator Content, ownership claims, credits, ratings, tool disclosures, source links, rankings, reviews, comments, metrics, or other platform data are accurate, complete, lawful, safe, current, or available. Mostra does not guarantee uninterrupted or error-free operation or that content will not be lost or altered.

The Service is not legal, financial, rights-clearance, employment, production, creative, or distribution advice.

TO THE FULLEST EXTENT PERMITTED BY LAW, MOSTRA AND ITS OWNER, PERSONNEL, SERVICE PROVIDERS, AND SUCCESSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, OPPORTUNITIES, OR BUSINESS INTERRUPTION, ARISING FROM OR RELATED TO THE SERVICE OR THESE TERMS.

TO THE FULLEST EXTENT PERMITTED BY LAW, MOSTRA'S TOTAL AGGREGATE LIABILITY ARISING FROM OR RELATED TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID MOSTRA FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) US $100.

These limitations do not exclude liability that cannot lawfully be excluded or limited. Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you.

To the extent permitted by law, you will defend, indemnify, and hold harmless Mostra, its owner, successors, service providers, and personnel from third-party claims, damages, judgments, settlements, and reasonable legal fees arising from your Creator Content, your breach of Sections 3 through 9, your violation of another person's rights, or your unlawful conduct.

Mostra will provide reasonably prompt notice of a covered claim and reasonable cooperation at your expense. You may not settle a claim in a manner that admits fault by or imposes obligations on Mostra without Mostra's written consent.

These Terms are governed by California law, without regard to conflict-of-law principles. Subject to non-waivable applicable law, you and Mostra consent to the exclusive jurisdiction of the state and federal courts located in San Francisco County, California.

Before filing a claim, the parties will make a good-faith effort to resolve the dispute informally by written notice. This requirement does not prevent either party from seeking urgent injunctive or equitable relief.

We may update these Terms to reflect changes to the Service, law, integrations, or business practices. We will post the updated Terms and revise the effective date. If a change materially affects your rights, we will provide additional notice where reasonably practicable or required by law.

Your continued use of the Service after updated Terms become effective means you accept them. If you do not agree to an update, stop using the Service and request account or data deletion as appropriate.

These Terms, the Privacy Policy, and any applicable signed agreement constitute the agreement between you and Mostra concerning the Service. You may not assign these Terms without Mostra's written consent. Mostra may assign them in connection with a financing, merger, acquisition, reorganization, asset sale, change of control, or transfer to a successor that assumes the applicable obligations.

If a provision is unenforceable, it will be modified only as necessary or severed, and the remaining provisions will remain effective. Failure to enforce a provision is not a waiver. Headings are for convenience only. Electronic notices and acceptances are effective.
